1. Introduction
These terms of service (“Terms”) govern your use of the website design, hosting, and related services provided by In Check Software Ltd, trading as In Check Websites (“we”, “us”, “our”). By using our services, you agree to be bound by these Terms.
2. Service Description
We provide website design, build, hosting, and support services for small businesses. Once the website is approved by you and goes live, we provide ongoing hosting, monitoring, and agreed support as part of a monthly subscription plan.
3. Pricing
Design and build fees are agreed before work begins. Hosting and support are charged monthly in advance according to your agreed monthly plan. We reserve the right to adjust pricing with 30 days’ written notice.
4. Satisfaction Guarantee
You may request reasonable revisions before approval according to your agreed plan. Once you approve the website and it goes live, your agreed monthly hosting and support payment becomes due.
5. Cancellation
You may cancel your hosting subscription at any time by providing one calendar month’s written notice via email to contact@incheckwebsites.com. Upon cancellation, your website will be taken offline at the end of the notice period. There are no exit fees or penalties.
6. Your Responsibilities
You agree to:
- Provide accurate information for use on your website
- Ensure any content you supply does not infringe third-party rights
- Respond to design review requests in a reasonable timeframe
- Make hosting payments on time
7. Intellectual Property
The website design and code created for you remain the intellectual property of In Check Software Ltd for the duration of your hosting subscription. You retain ownership of all content you provide (text, images, logos). Upon cancellation, we may remove the website from our hosting infrastructure. If you wish to retain the website files, please request them before your subscription ends.
8. Updates & Maintenance
Your monthly hosting plan includes minor content updates such as changes to text, images, phone numbers, and opening hours. Larger changes, including new pages, structural modifications, or additional features, will be quoted separately and require your approval before work begins.
9. Limitation of Liability
To the fullest extent permitted by law, In Check Software Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability in any claim arising from or related to our services shall not exceed the total amount paid by you in the twelve months preceding the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Service Availability
We strive to ensure your website is available 24/7 but do not guarantee uninterrupted service. We are not liable for temporary downtime caused by maintenance, third-party provider issues, or circumstances beyond our reasonable control.
11. Third-Party Services
Our services may integrate with or rely on third-party providers (e.g. domain registrars, email services). We are not responsible for the availability or performance of third-party services. Any additional costs from third-party providers (such as domain registration fees) are your responsibility.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active customers via email at least 30 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
